Afghan Voice Agency (AVA) – Tehran: In today’s (Monday, November 3) meeting of the Joint Commission to Review the Bill on the Structure, Duties and Powers of the National Migration Organization, representatives of the Islamic Consultative Assembly of Iran agreed to Articles 1 and 2 of this bill.
This decision was made with the aim of establishing an independent organization to organize the affairs of migrants and foreign nationals in Iran so that management, planning and policy-making in the field of migration can be carried out in a centralized and coordinated manner.
Article 1 of this bill states.
Part One: Definitions
In this law, the following terms are used in their respective meanings:
1- Organization: The National Migration Organization, which is referred to as the Organization in this law for short.
2- Council: The Council for Policy-Making and Coordination of Migrants and Foreign Nationals Affairs, subject to Article (5) of this law.
3- Foreign nationals: Individuals without citizenship of the Islamic Republic of Iran who have entered the territory of the country of Iran and are subject to one of the titles subject to paragraphs (4) to (8) of this article.
4- Legal immigrant: A foreign national whose application for entry or residence in the country of Iran has been accepted by the government of the Islamic Republic of Iran within the framework of relevant laws and regulations.
5- Illegal immigrant: A foreign national and stateless individuals who have entered the territory of the country of Iran illegally or who have not left the country of Iran within the prescribed period despite having entered legally.
6- Asylum seeker: A foreign national who has applied for asylum from the Islamic Republic of Iran by providing evidence (based on the definitions described in Article 1 of the Convention Relating to the Status of Refugees, approved in 1951 and Article 155 of the Constitution of the Islamic Republic of Iran) and whose application is under consideration.
7- Refugee: An asylum seeker whose asylum application has been accepted by the government of the Islamic Republic of Iran.
8- Refugee: A foreign national who, due to emergency reasons, including natural disasters, civil or international war, has left or been forced to leave his/her country of origin or place of residence and has entered the territory of Iran.
9- Reception camp: A place for temporary detention of refugees (without visas) and refugees (until the asylum application is processed) and illegal immigrants (until the determination of their status or leaving the country).
10- Guest city: An area established or designated by the organization for the settlement of immigrants and authorized foreign nationals.
11- Residence: A special permit granted by the legal authorities responsible for the Islamic Republic of Iran to a foreign national to legally reside in the country.
12- Residence card: An identification document issued to a foreign national who has residency in the Islamic Republic of Iran.
13- Foreign National Identification Number: A unique number with a specific identifier that all requests and services for foreign nationals (except for emergency situations such as the need for treatment in life-threatening cases) are subject to receiving this number, which is assigned by the National Migration Organization.
14- The comprehensive database is an integrated system for collecting and presenting all information such as identity, biometrics, and economic information of foreign nationals that is formed in the organization and all its services are made available to service providers through the national window of smart government services.
15- Real Estate and Housing Database: The basic system is the subject of row 25, article 10 of the National Data and Information Management Law approved on 30/6/1401 with subsequent amendments and additions.
16- Foreign Nationals Job Database: A system that is used by the Ministry of Cooperatives, Labor and Social Welfare to announce the need for foreign nationals and comply with the National Data and Information Management Law (approved on 10/8/1401 with subsequent amendments and additions), which is referred to as the Job System in this law, and is made publicly available through the Single Government Services Window.
17- Foreign Nationals Organization Commission: The Foreign Nationals Organization Commission, which is referred to as the Organization Commission in this law, is established in the organization under the chairmanship of the head of the organization and with the membership of representatives of the Ministries of Information, Cooperatives, Labor and Social Welfare, Foreign Affairs and the Chief of Police of the Islamic Republic of Iran, the Commander-in-Chief of the Islamic Revolutionary Guard Corps, and the Judiciary by judicial notification in line with the duties assigned in this law, and its counterpart in the provinces is established under the chairmanship of the governor and representatives of the agencies mentioned in this paragraph.
18- Atlas of Employment of Foreign Nationals: The database and number of the country's employment requirements for foreign nationals, broken down by province, based on the announcements of employers, which is prepared and announced by the Ministry of Cooperation, Labor and Social Welfare, which is referred to in this law as the Atlas of Employment.
19- Exit station: A place used as the last place for the departure or expulsion of immigrants and foreign nationals.
It is also stated in Article 2 of this bill; In order to organize the affairs of immigrants and foreign nationals, coordinate and enhance the coordination between relevant agencies, manage, plan and effectively interact with relevant institutions and organizations, the "National Immigration Organization" with independent legal personality shall be established as a state institution affiliated with the Ministry of Interior.
Note 1- The organization is organized at the national level in terms of organization, and its provincial counterparts shall perform their duties independently under the supervision of the organization.
Note 2- The head of the organization is appointed as the Deputy Minister of Interior by his decree and is responsible for the administration of the organization within the framework of laws and regulations.
Note 3 - The organization's financial resources include government funds foreseen in the annual budget laws, gifts and donations from natural and legal persons, both domestic and international, in compliance with relevant laws and regulations, as well as funds obtained from the organization's provision of services to immigrants and foreign nationals.
Note 4- The regulations of the administrative structure of the organization shall be prepared by the Ministry of Interior within a maximum of 3 months after the entry into force of this law, in cooperation with the Planning and Budget Organization and the Administrative and Employment Organization, and shall be approved by the Council of Ministers.
