Afghan Voice Agency (AVA): According to the Afghanistan Analysts Network, the non-initiation of the war crimes case in Afghanistan means that this court has not yet gone beyond the preliminary review stage 16 years after the start of its investigation into Afghanistan.
This is despite the fact that the prosecutor of the International Criminal Court asked this court to speed up its work on Afghanistan 10 months ago.
The judges appear to be considering who is now representing Afghanistan to decide whether the previous administration's request to delay the investigation still stands.
In 1400, the International Criminal Court asked the United Nations to introduce the official representative of Afghanistan. The judges of this court said last year that until the official representation of Afghanistan is determined, they cannot make a decision on resuming the investigation of war crimes in this country.
The seat of Afghanistan's representative in the United Nations is still held by the representative of the previous government, and "Islamic Emirate" cannot own this seat due to the lack of official recognition by this organization.
Previously, this court had investigated war crimes in Afghanistan; But at that time, America, whose forces were accused of committing massive war crimes in Afghanistan, did not allow this process to end by threatening and sanctioning the prosecutors of this court.
